Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Onwardz platform, including the API, SDKs, dashboard, and all related services (collectively, the "Service"), operated by Ghiu Alexandru-Nicolae Persoană Fizică Autorizată ("Onwardz", "we", "us", or "our").

By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended for developers and businesses. To use Onwardz you must:

• Be at least 18 years of age, or be using the Service on behalf of a business entity with authority to bind that entity to these Terms
• Not be prohibited from using the Service under applicable law

Onwardz is a developer API platform. It is not a consumer product. The end users of applications you build using Onwardz are your responsibility, and your relationship with them is governed by your own terms of service.

2. Account Registration

To access the Service you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your API keys and session credentials and for all activity that occurs under your account. You must notify us immediately at hello@onwardz.com if you suspect unauthorised access.

3. Description of Service

Onwardz provides a real-time video and chat infrastructure API that enables developers to embed peer-to-peer video rooms into their applications. The Service includes a signalling server, browser SDK (@onwardz/js), server SDK (@onwardz/node), a developer dashboard, and associated documentation.

Once peers connect, media and chat flow directly between participants; when a direct connection is not possible, they are relayed through a TURN server for connectivity. In either case the media is end-to-end encrypted, and Onwardz does not access, store, or process the content of your video calls or chat messages.

4. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to transmit, distribute, or store any content that violates applicable law or the rights of any third party
• Use the Service to harass, threaten, defame, or harm any person
• Use the Service to record, monitor, or surveil individuals without their knowledge and consent
• Use the Service to send unsolicited messages or engage in automated abuse of the API
• Create multiple accounts to circumvent usage limits or billing caps
• Attempt to reverse-engineer, decompile, or otherwise derive source code from the Service
• Use the Service in any way that could damage, disable, or impair our infrastructure or interfere with other customers

5. Billing & Subscriptions

Certain features of the Service require a paid subscription. Subscriptions are billed monthly in advance through Stripe. By subscribing you authorise us to charge your payment method at the start of each billing period.

Cancellation: You may cancel your subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period, after which your account reverts to the free tier.

Refunds: All payments are final. No refunds are issued for partial billing periods or unused usage.

We reserve the right to change pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Intellectual Property

The Service, including all software, documentation, and branding, is the property of Ghiu Alexandru-Nicolae PFA and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

You retain ownership of any applications you build using the Service. By using the Service you grant us no rights to your application code or your end users' data.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not guarantee that the Service will be error-free or that any defects will be corrected.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Ghiu Alexandru-Nicolae PFA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, with or without notice. You may terminate your account at any time by contacting us at hello@onwardz.com.

Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, and 10 survive termination.

10. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Romania.

11. Data Protection & Your End Users

You are the data controller for any personal data of your end users that is processed through your use of the Service; Onwardz acts as a data processor on your behalf and processes such data only to provide the Service. You are responsible for establishing a lawful basis for processing your end users' personal data and for providing them with any required notices or obtaining any required consent.

Where the GDPR or similar laws apply, our Privacy Policy and a Data Processing Agreement (available on request at hello@onwardz.com) govern our processing of personal data on your behalf, including our use of sub-processors and the security measures we apply.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or by posting a notice on the dashboard. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
